Abstract

In this paper the author analyzes some of the ideas developed by Roberto Gargarella in his most recent work. This ideas could have a certain parallelism with some theoretical formulations that have been postulated for decades within the international law doctrine in order to enunciate the submission of power to Law in the international field.

Doctor en Derecho por la Universidad de Sevilla; Máster en Jurisdicción Penal Internacional por la Universidad Internacional de Andalucía (España); Profesor e Investigador Honorario de las Universidades de Xalapa y Autónoma de Ciudad Juárez (México); Profesor de la Facultad de Derecho de la Universidad de Sevilla; ha realizado estancias de investigación en las Universidades Robert Schuman de Estrasburgo, Ámsterdam, Leiden, Helsinki, Bolonia y en el Instituto Max Planck de Heidelberg.
